House Proposes 25-Year Jail Term, N10 Million Fine For Separatist Agitation

The Nigerian House of Representatives is considering a significant legislative change that could have far-reaching implications. According to the Counter Subversion Bill 2024, any person convicted of making a statement or taking an action that leads to separatist agitation or inter-group conflict may face severe penalties.

25-Year Imprisonment for Individuals found guilty could be sentenced to up to 25 years in prison. N10 Million Fine Alternatively, a hefty fine of N10 million may be imposed.  The court has the discretion to apply either the jail term, the fine, or both.

The legislation aims to criminalize subversive activities by various groups, including associations, organizations, militias, cults, and other proscribed entities in Nigeria. It seeks to maintain peace, security, and the corporate existence of the nation.

Destruction of national symbols, refusal to recite the national anthem and pledge, and defacing places of worship with intent to cause violence are also addressed. Illegal roadblocks, unauthorized road traffic functions, and illegal processions are subject to penalties. Castigating or denigrating community, religious, or government leadership can result in fines or imprisonment.

Receiving financial or political support from foreign organizations or countries incompatible with Nigeria’s interests could lead to a fine of N15 million or 20 years in prison.

The Counter Subversion Bill 2024 is currently awaiting its second reading in the House of Representatives. If passed, it will significantly impact how separatist activities are addressed in Nigeria.
